1. Information We Collect

When you use Implenta's AI phone services, we collect:

  • Phone numbers and names provided during reservation booking
  • Reservation details (date, time, party size)
  • Call recordings (when enabled by the restaurant)
  • SMS message content related to reservations

2. SMS Communication & Consent

Verbal Consent Process: During your phone reservation with Implenta's AI assistant, you will be asked: "Can I send you a text message to confirm your reservation?" By verbally agreeing (saying "yes," "okay," or similar affirmative response), you consent to receive SMS messages related to your reservation. All calls are recorded and stored as proof of consent.

Messages you may receive:

  • Reservation confirmation messages
  • Reservation reminder messages (if enabled by the restaurant)
  • The ability to manage your reservation via SMS reply

Message Frequency: You will typically receive 1-2 messages per reservation. Message and data rates may apply based on your mobile carrier's plan.

Opt-Out: You can opt out at any time by replying STOP, CANCEL, or UNSUBSCRIBE to any message. You can also reply HELP for assistance or contact us at contact@implenta.com or (855) 592-8674.

TCPA Compliance: We comply with the Telephone Consumer Protection Act (TCPA). We will never send unsolicited marketing messages. All SMS communications are transactional and directly related to your reservation request. Consent is not required as a condition of purchase.

3. How We Use Your Information

We use your information to:

  • Process and confirm your reservations
  • Send SMS confirmations and reminders
  • Improve our AI agent's performance
  • Provide customer support
  • Comply with legal obligations

4. Data Retention

By default, we retain call recordings and reservation data for 90 days. Call recordings (when enabled) are retained for compliance and quality assurance purposes. After this period, data is automatically deleted unless extended retention is required for legal or operational purposes.

5. Data Sharing

We do not sell your personal information. We may share your data with:

  • The restaurant you made a reservation with
  • Service providers (Twilio, OpenAI, Airtable, Make.com) necessary to operate our service
  • Law enforcement when required by law

6. Your Rights

You have the right to:

  • Access your personal information
  • Request deletion of your data
  • Opt out of SMS communications (reply STOP)
  • Request call recording be disabled
  • Withdraw consent at any time

7. Call Recording

Call recording is optional and determined by each restaurant client. When call recording is enabled, callers are notified at the beginning of the call. Recordings are used to improve service quality, maintain proof of SMS consent, and resolve disputes. Recordings are stored securely and deleted after 90 days.

8. Security

We implement industry-standard security measures to protect your information, including encryption, secure data transmission, and access controls. However, no system is 100% secure.

9. Changes to This Policy

We may update this privacy policy from time to time. We will notify you of significant changes by updating the "Last updated" date at the top of this page.
